Terms of Service

1. Acceptance of Terms

By accessing or using the YO Gamesale Consignor Portal ("Portal"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Portal. These Terms constitute a legally binding agreement between you and YO Gamesale.

2. Consignor Eligibility

To use the Portal as a consignor, you must be at least 18 years of age and have a valid consignor agreement with YO Gamesale. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Consignment Agreement

When you submit items for consignment through the Portal, you confirm that:

• You are the rightful owner of all submitted items.
• All items are accurately described, in the condition stated, and free of any liens or encumbrances.
• You grant YO Gamesale the right to sell, display, and market the items on your behalf.
• Pricing and sale terms are subject to the commission structure agreed upon at registration.

4. Fees and Payments

YO Gamesale retains a commission on each sale as outlined in your consignor agreement. Payouts for sold items are processed according to the payment schedule communicated at registration. YO Gamesale reserves the right to adjust commission rates with 30 days' written notice.

5. Item Condition and Returns

You are responsible for accurately grading and describing the condition of all items. YO Gamesale may re-grade items upon receipt and adjust listings accordingly. Items that do not meet the described condition may be returned to the consignor at the consignor's expense.

6. Unsold Items

Items that remain unsold after the agreed consignment period will be made available for pickup or return shipping at the consignor's expense. Items not retrieved within 30 days of notification may be donated or disposed of at YO Gamesale's discretion.

7. Prohibited Items

You may not submit items that are counterfeit, stolen, illegal, or otherwise prohibited by applicable law. YO Gamesale reserves the right to refuse or remove any item at its sole discretion without liability.

8. Limitation of Liability

To the fullest extent permitted by law, YO Gamesale shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Portal or the consignment of items. Our total liability to you shall not exceed the total commissions paid by you in the six months preceding the claim.

9. Account Termination

Either party may terminate the consignor relationship at any time with written notice. Upon termination, all unsold items will be returned to you at your expense. Outstanding payouts for sold items will be processed according to the standard payment schedule.

10. Changes to These Terms

YO Gamesale may update these Terms from time to time. Continued use of the Portal after changes are posted constitutes your acceptance of the revised Terms. We will notify registered consignors of material changes by email.
